MIAMI association of REALTORS® Corporate Affiliate Membership AGREEMENT
I hereby apply for a Corporate Affiliate Membership with the MIAMI ASSOCIATION OF REALTORS® (“MIAMI”). In the event that this application is approved, I agree to abide by this Agreement, and the Bylaws of MIAMI which may change from time to time with or without notice. I understand it is my responsibility to stay informed about any changes and to ensure my ongoing compliance with the terms of this Agreement and MIAMI bylaws.
I understand that a Corporate Affiliate Membership with MIAMI does not include membership in the NATIONAL ASSOCIATION OF REALTORS® or Florida REALTORS®. I understand that Corporate Affiliate Membership shall not be construed to create a partnership or joint venture between me, the Affiliate Business listed on this Application, and MIAMI.
I understand that I may not make any unsolicited contact with broker and/or real estate agent members (“Members”) of MIAMI, for marketing purposes or otherwise, without the express written permission of MIAMI. I agree that I will comply with the CAN-SPAM Act and that I will not share, publicize, sell, send, and/or otherwise distribute Members’ information to any third parties.
I understand that MIAMI reserves the right to change, limit or eliminate the Affiliate Membership Program or any of its benefits at any time. I also understand that MIAMI has the right to change the terms and conditions of membership, including dues amounts, and various membership levels and benefits at any time. I agree that Affiliate Member benefits may only be used for my registered Affiliate Business listed in this Application. All components of the Affiliate Membership Program are nontransferable within the Affiliate Business or to another individual.
Affiliate Members cannot use any benefit offered through the Affiliate Membership Program to promote or perform any licensed real estate activity or to do anything which would be a violation of federal, state, or local laws or a violation of any agreement of which the Affiliate Business or Affiliate Member is a party thereto.
I understand that during the time my Corporate Affiliate Membership is active, I have a revocable limited license to display the MIAMI REALTORS® Corporate Affiliate logo on my website, e-mails, and social media to indicate my membership. This revocable limited license to display the MIAMI REALTORS® Corporate Affiliate logo may be immediately revoked if my membership expires, I am non-compliant with the terms and conditions of this Agreement, or I do not renew it.
I understand that my continued membership in the MIAMI Affiliate Program is dependent on my timely payment of all dues as charged by MIAMI. I acknowledge that dues and fees are nonrefundable and not prorated and that annual membership begins from the date that my Affiliate Membership was initially approved.
I expressly authorize MIAMI and its subsidiaries, affiliates and/or representatives to call, fax, or e-mail me, at the phone number and e-mail address provided above with respect to any goods or services offered or promoted by MIAMI. I understand that this consent also applies to changes in contact information that I may provide to MIAMI in the future. Should the contact information above change, I shall promptly notify MIAMI of any changes. I also expressly authorize MIAMI to include my name, company name, company logo, address, phone number and e-mail address in all marketing communications, both online and offline.
I agree that non-compliance, alleged non-compliance, or suspected non-compliance with the terms and conditions herein, in MIAMI’s sole discretion, will result in the immediate termination of my Affiliate Membership, including all Member benefits and MIAMI shall suffer no penalty or liability resulting from such termination. I agree that should I cease to be an Affiliate Member I will discontinue use of the term Affiliate and discontinue use of the Affiliate Member logo in any manner whatsoever.
I hereby certify that the foregoing information furnished by me is true and correct, and I agree that failure to provide complete and accurate information as requested, or any misstatement of fact, shall also be grounds for revocation of my membership, if granted.
